Introduction
These Terms of Service ("Terms") govern your use of SiteCalc® Pro, operated by SiteCalc® Pro ("we", "us", or "our"). By creating an account or using the app, you agree to these Terms. If you do not agree, do not use the service.
Description of Service
SiteCalc® Pro is a software-as-a-service (SaaS) platform designed for contractors, landscapers, and field service companies. It provides tools for quoting, job management, invoicing, client communications, client portal access, and material and labor calculators. Features may vary by subscription plan.
Account Responsibilities
You must be at least 18 years old to create an account.
You must provide accurate, current, and complete information when registering.
You are responsible for maintaining the security of your account credentials.
You are responsible for all activity that occurs under your account, whether authorized by you or not.
Notify us immediately at info@sitecalc.pro if you suspect unauthorized access to your account.
Subscriptions & Billing
Paid plans are billed monthly in advance.
Billing is handled securely through Stripe. By subscribing, you authorize recurring charges to your payment method.
You may cancel your subscription at any time. Cancellation stops future renewals, but you retain access through the end of your current paid billing period.
We do not offer refunds for partial billing periods, except where required by applicable law.
We reserve the right to change pricing with reasonable prior notice. Continued use after a price change takes effect constitutes acceptance of the new pricing.
Acceptable Use
You agree not to use SiteCalc® Pro to:
Violate any applicable law or regulation.
Attempt to gain unauthorized access to the service, other accounts, or related systems.
Reverse engineer, copy, resell, sublicense, or redistribute any part of the service.
Upload or transmit malicious code, viruses, or harmful content.
Interfere with or disrupt the operation of the service or its infrastructure.
Use the service for any purpose other than your own legitimate business operations.
We reserve the right to suspend or terminate accounts that violate these rules.
Your Data
You retain full ownership of all business data you enter into SiteCalc® Pro, including clients, quotes, jobs, invoices, and materials. By using the service, you grant SiteCalc® Pro a limited, non-exclusive right to host, store, process, and display your data solely as necessary to operate and improve the service on your behalf. We do not claim ownership of your data and do not use it for any other purpose. Data handling is governed by our Privacy Policy.
Third-Party Integrations
SiteCalc® Pro integrates with the following third-party services to deliver requested functionality. By using these features, you agree that your data may be processed by these providers as necessary:
Stripe: payment processing and subscription billing.
Resend: transactional email delivery.
Twilio: SMS communications, opt-in management, and messaging delivery to clients.
QuickBooks (Intuit): accounting and invoice sync, only when you connect your QuickBooks account.
Google: optional sign-in via Google. See "Third-Party Authentication" below.
Each provider is subject to their own terms and privacy policies. We are not responsible for the practices of third-party providers.
Third-Party Authentication
SiteCalc® Pro offers the option to sign in using Google Sign-In. When you use this feature, Google may share basic profile information (such as your name and email address) with SiteCalc® Pro to create or access your account. We do not receive or store your Google password. Your use of Google Sign-In is also subject to Google's Terms of Service and Privacy Policy. We do not use data received through Google Sign-In for advertising purposes.
Service Availability
We aim to keep SiteCalc® Pro available at all times, but we do not guarantee uninterrupted access. The service may be temporarily unavailable due to maintenance, updates, or factors outside our control. We reserve the right to modify, suspend, or discontinue features at any time with reasonable notice when possible.
Intellectual Property
All software, branding, designs, and content within SiteCalc® Pro (excluding your business data) are owned by or licensed to SiteCalc® Pro. Nothing in these Terms grants you rights to our intellectual property beyond what is necessary to use the service.
Disclaimer of Warranties
The service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the service will be error-free, uninterrupted, or suitable for any particular purpose. Use of the service is at your own risk.
Limitation of Liability
To the fullest extent permitted by law, SiteCalc® Pro shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service, including but not limited to loss of business, revenue, data, or goodwill. Our total liability to you for any claim arising from these Terms shall not exceed the amount you paid to us in the twelve months preceding the claim.
Termination
We may suspend or terminate your account if you violate these Terms, with or without notice depending on the severity of the violation.
You may close your account at any time by contacting us at info@sitecalc.pro.
Upon termination, your access to the service will cease. Handling of your data following termination is governed by our Privacy Policy.
Changes to Terms
We may update these Terms from time to time. If we make material changes, we will notify you via email or in-app notice. Your continued use of SiteCalc® Pro after the updated Terms take effect constitutes your acceptance of the revised Terms.
Governing Law
These Terms are governed by the laws of the State of New York, without regard to its conflict of law principles. Users located outside New York may also have rights under applicable local consumer protection laws, which these Terms do not limit.
